Premium package t&cs

1. Booking & Payment

• Full payment is required at the time of booking to secure your session.

• Payment methods: PayID, bank transfer and cash. 

• Bookings are only confirmed once payment is received 

• Cancellations made more than 48 hours before the event will be refunded in full.

• Cancellations made within 48 hours of the event are non-refundable. 

• Payments are non-refundable under any circumstances of dissatisfaction with the final images. 

2. Photo delivery 

• Edited photos will be delivered within the timeframe according to the purchased package via Google Drive (or another agreed-upon method). 

• All delivered images will include a small watermark for branding and copyright protection. 

• Unwatermarked versions may be available at an additional fee of $20 per image. 

3. Usage Rights

• Watermarks must not be cropped or edited out without written permission. 

• Individuals may use images for personal use, including social media. However, if the images are used to promote themselves professionally (e.g., attracting sponsorship and advertisements) this is considered commercial use and requires written permission and may incur a licensing fee. 

• Teams may use images for commercial use (promotions, advertisements, and media outlets) and social media.

• Jmsportscapture retains the copyright and may use images for portfolio, website, articles and social promotion unless otherwise agreed. Images may be sold to individual players for personal use, including sharing on social media, but may not be used for commercial purposes without prior written consent

4. Weather & Rescheduling

• In the event of weather-related postponement, the photographer will make every effort to accommodate a new date for the shoot. However, if the rescheduled date conflicts with the photographer's availability, the client has the right to either: 

  • • Move the booking to an alternative date that works for both parties. 

    • Request a full refund of any payment made. 

• If the client cancel due to weather and the match is still played, the payment is non-refundable. 

• In the event that the photographer determine that weather conditions are unsafe or pose a risk to our equipment, the photographer reserves the right to cancel the shoot. This decision will be made at the photographer's sole discretion. In such cases, the client will receive a full refund of any payments made. 

5. Travel & Location

• Clients are responsible for ensuring the location is accessible and suitable for photography.

• Packages include travel within a 30km radius of the Sutherland Shire. 

• Travel beyond this distance may incur an additional fee, which will be discussed and agreed upon during booking. 

6. Performance Guarantee

• The photographer will make every reasonable effort to deliver the best quality images in line with the Client's requirements and expectations. However, due to the nature of photography, the photographer cannot guarantee specific outcomes or results, including but not limited to: 

  • • The exact timing or appearance of shots due to uncontrollable factors such as lighting, weather or venue constraints.

    • The availability of specific moments or shots as these are subject to unpredictable variables. 

• The photographer offers up to two rounds of included editing. Additional edits will incur a fee of $10 per photo. 

7. Consent & Access

• By booking, you confirm that you have permission to have photos taken at the venue and of the individuals being photographed.
